Hawaiʻi County Prosecuting Attorney Kelden Waltjen announced that 44 year-old Timothy Nacis of Pa`auilo was charged for attempted possession and distribution of over 5 pounds of methamphetamine and damaging a police subsidized vehicle following his January 3rd arrest in Pa`auilo.

The Complaint alleges that Nacis, a repeat offender with 3 prior felony convictions, was charged with 7 offenses including 2 counts of Attempted Promoting a Dangerous Drug in the First Degree (possession of over an ounce of methamphetamine), 1 count of Attempted Promoting a Dangerous Drug in the First Degree (attempted distribution of over an eight of an ounce of methamphetamine), Criminal Property Damage in the Second Degree (property damage to a Chevrolet Tahoe in an amount which exceeded $1,500.00), Ownership or Possession Prohibited, Promoting a Dangerous Drug in the Second Degree (possession of over an eighth of an ounce of methamphetamine), and Prohibited Acts Related to Drug Paraphernalia.

If convicted as charged, Nacis faces sentencing to a mandatory minimum prison term without the possibility of parole. Nacis is scheduled to make his initial appearance on Thursday, January 6 in Hilo District Court. He remains in custody in lieu of $200,000.00 bail.

The investigation was the result of a combined effort by members of the Hawai`i Police Department’s Area I Vice Section, Area I Special Enforcement Unit, and U.S. Department of 2 Homeland Security Investigations. The case is being prosecuted by Deputy Prosecuting Attorney Elyssa Correia Keltner. The charges are merely allegations, and the Defendant is presumed innocent unless and until proven guilty.
