Hilo Man Charged With First Degree Assault on Police Officer, Criminal Property Damage, and Other Offenses

Prosecuting Attorney Kelden Waltjen announced that 22 year-old Kade Kapika-Overturf of Hilo was charged in relation to a January 21st incident at an Orchidland gas station.

As the Complaint alleges, Kapika-Overturf was charged with 7 offenses including Assault Against a Law Enforcement Officer in the First Degree, Criminal Property Damage in the First Degree (cause damage to another person’s property and recklessly place another person in danger of death or bodily injury), two counts of Criminal Property Damage in the Second Degree (cause over $1,500 damage to another person’s property, two police subsidized vehicles), Resisting an Order to Stop in the First Degree (fail to stop motor vehicle while fleeing from police and operate a motor vehicle in reckless disregard of the safety of others), Promoting a Dangerous Drug in the Second Degree (possession of over an eighth of an ounce of methamphetamine), and Prohibited Acts Related to Drug Paraphernalia.

At the time of his arrest, Kapika-Overturf was also wanted for an outstanding warrant for another unrelated felony matter. Review of court records indicate that at the time of alleged offenses, Kapika-Overturf was pending three other unrelated felony matters, where he was previously granted supervised release over Prosecutors’ objections.

The case was handled by Officers Bryson Miyose and Terence Scanlan, Puna Patrol, and Detective Blaine Morishita, Area I Criminal Investigation Section, Hawai‘i Police Department. The case is being prosecuted by Deputy Prosecuting Attorney Kevin Soong.

The charges are merely allegations, and the Defendant is presumed innocent unless and until proven guilty.
